Terms of Use

These Terms of Use ("Terms") govern your use of YotPlace, including the website, mobile apps and related services (the "Service"), operated by YotPlace LLC ("we", "us"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. What YotPlace is

YotPlace is an online marketplace where licensed yacht brokers and dealers ("Brokers") advertise boats for sale and where buyers can search, save and inquire about those boats. We are not a broker, dealer, seller or agent, and we are not a party to any sale. Every transaction is between you and the Broker or seller.

2. Listing information

Listings are created by Brokers. Brokers are responsible for the accuracy of the information, photos and prices they publish. We don't inspect boats and don't verify every detail, and AI-assisted descriptions are reviewed and approved by the listing Broker. Before buying any boat, you should independently verify its condition, specifications, ownership and title, including through a professional marine survey and sea trial.

Price history, days on market and market comparisons are provided for information only and are not appraisals or valuations.

3. Accounts

You must provide accurate information and keep your login details secure. You're responsible for activity under your account. You must be at least 18 to create an account. We may suspend or close accounts that break these Terms or put other users at risk.

4. Contacting Brokers

When you send an inquiry, your name, contact details and message are shared with the listing Broker so they can respond. Brokers handle your information under their own policies as well as ours. Please don't use the Service to send spam, harass anyone, or collect contact information.

5. Acceptable use

You agree not to:

  • scrape, copy or republish listings or data from the Service except through features we provide;
  • post false, misleading or unlawful content, or impersonate anyone;
  • interfere with the Service's security or operation, or access it by automated means without our permission;
  • use the Service to commit fraud. We will never ask you to wire money, and you should be wary of anyone who asks you to send funds outside a documented, escrowed transaction.

6. Intellectual property

The Service, its design and software belong to us or our licensors. Listing content belongs to the Broker or its licensors. You may use the Service for your personal, non-commercial boat search, or, if you are a Broker, as allowed by your Broker agreement.

7. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including about the accuracy of listings, the condition of any boat, or the conduct of any Broker or user.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from a transaction between users and Brokers. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.

9. Changes

We may update these Terms. If changes are material, we'll give notice on the Service or by email. Continuing to use the Service after changes take effect means you accept them.

10. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Michigan.
