Broker Terms

These Broker Terms apply to licensed yacht brokers, dealers and brokerages ("Brokerage", "you") that list boats on YotPlace, operated by YotPlace LLC ("we"). They add to our general Terms of Use.

1. Eligibility and verification

You confirm that you and every team member you add hold any licence required to broker or sell boats where you operate (for example, Florida and California require yacht broker licences), and that you have authority to bind your Brokerage. We may verify business and licence details before showing a "verified" badge, and may refuse or remove listings from accounts we can't verify.

2. Your listings

  • You may only list boats you are authorized to market by the owner, under a current listing agreement or with the owner's permission.
  • You are responsible for listing accuracy, including specifications, equipment, condition, price and location. Review AI-assisted descriptions before publishing; you are responsible for what you publish.
  • Mark boats as under contract, sold or withdrawn promptly, and remove listings when your authority to market them ends.
  • You confirm you have the rights to every photo, video and text you upload.

3. Your data

Your listing data and customer data belong to your Brokerage. You grant us a non-exclusive licence to host, display, adapt (for example, resize photos) and promote your listings on YotPlace, in search engines, in emails to buyers and in our marketing, for as long as they are published and for a reasonable period afterwards for sold-boat history. You can export or remove your listings at any time.

4. Leads and buyer information

Inquiries are routed to your Brokerage. Use buyer information only to respond to and serve that buyer, in line with applicable law, including anti-spam rules. Don't add buyers to unrelated marketing without their consent.

5. Owner reports

If you enter a boat owner's contact details, you confirm the owner has agreed to receive performance reports from you through YotPlace. You can turn reports off per listing.

6. Fees

During the Founding Brokerage program, listing on YotPlace is free for 12 months from your sign-up date, after which founding pricing applies. We'll give at least 30 days' notice before any paid plan starts, and you can stop at any time before then.

7. Conduct and removal

We may remove listings or suspend accounts that are inaccurate, misleading, duplicative, unauthorized or that put buyers at risk, and we'll tell you why where we can.

8. Term and termination

Either party may end these Broker Terms at any time. When you close your account, your listings are removed from the marketplace.

9. Liability

The limitations of liability and disclaimers in the Terms of Use apply. You will indemnify us against claims arising from your listings or your dealings with buyers and sellers.
